Mr Faraj’s client, a 34 year old truck driver, was charged with the following offences:
- Intentionally choke another
- Stalk/intimidate
- Breach Apprehended Domestic Violence Order
These are serious offences which can add up to lengthy terms of imprisonment given their domestic nature. The most serious, being the charge of intentionally choke another.
He was in a relationship with the complainant for 2 years and broke up with her in late 2020. After the breakup, his ex-girlfriend attended a police station and made several historical allegations against him which was clearly a payback tactic however, still resulted in him being charged by police.
The complainant gave evidence in court and was vigorously cross-examined by Mr Faraj in respect to not only the delay in her allegations, but also the photographs of the injuries she provided to police which did not seem consistent with the injuries she described.
The prosecution case was picked apart through cross-examination as neither the complainant, nor the police could explain the inconsistencies in their evidence and photographs of the alleged injuries.
Another point made was that the complainant in this matter waited and made this allegation to the police on his client’s birthday, another point in relation to payback tactics based off of false allegations.
Her motive to fabricate the allegations could not be ignored given the inconsistencies and weaknesses in the prosecution case and ultimately, the court handed down verdicts of not guilty to each charge.
